AUTOMOTIVE LIABILITY DISCLAIMER & ASSUMPTION OF RISK AGREEMENT
IMPORTANT NOTICE – READ CAREFULLY BEFORE PURCHASE, INSTALLATION, AND USE

This agreement applies to the purchase and use of HIGH RISERS (the “Product”), a vehicle-mounted roof rack mounting system designed to support cargo and utility boxes.
By purchasing, installing, or using the Product, you acknowledge and agree to the following:

1. Installation Responsibility
You agree to follow all instructions, warnings, and guidelines provided with the Product.
Improper installation may result in product failure, vehicle damage, loss of cargo, or serious injury or death.

If you are not experienced with automotive rack systems, professional installation is strongly recommended.

2. Load Ratings & Weight Limits (CRITICAL)
You acknowledge and agree that:
   •    The maximum allowable load is determined by the lowest rated component in the system, including:
   ◦    The cargo box manufacturer
   ◦    The roof rack or crossbar system
   ◦    The vehicle manufacturer
   •    You must not exceed the load rating specified by the cargo box manufacturer, including the combined weight of:
   ◦    The cargo box
   ◦    All contents inside the box
   ◦    Any attached accessories or mounting hardware
   •    If multiple components specify different limits, the lowest stated limit governs

Dynamic vs. Static Load
   •    Dynamic Load (while driving): Must not exceed manufacturer-rated limits
   •    Static Load (vehicle parked): May be higher but does not apply to driving safety

Dynamic Force Warning
You acknowledge that real-world conditions significantly increase stress on mounted systems, including:
   •    Wind resistance and aerodynamic lift
   •    Vehicle speed
   •    Road vibration and terrain
   •    Sudden braking, acceleration, or turning
   •    Off-road use
These forces may cause effective loads to exceed stated ratings.
Exceeding safe load limits may result in catastrophic failure, including detachment of cargo.

3. Cargo Box & Aerodynamic Forces
You acknowledge that cargo boxes:
   •    Create drag and lift at highway speeds
   •    Increase leverage on mounting points
   •    Can shift or destabilize if improperly loaded
You agree to:
   •    Use only properly rated and compatible cargo boxes
   •    Ensure all cargo is evenly distributed and secured
   •    Confirm all latches and mounts are fully engaged before driving
   •    Reduce speed in high wind or adverse conditions

4. Torque, Fastening & Re-Tightening Requirements
You agree that:
   •    All fasteners must be properly tightened during installation
   •    If torque specifications are provided, they must be followed
   •    If not provided, fasteners must be securely tightened using appropriate tools and mechanical judgment
Mandatory Re-Check
You must:
   •    Re-check and re-tighten all mounting hardware after the first 25–50 miles of use
   •    Inspect and re-tighten periodically thereafter, including before long trips
Failure to properly secure fasteners may result in loosening, detachment, or failure.

5. Inspection, Maintenance & Use
You agree to regularly inspect the Product and all related components, including:
   •    Mounting brackets and hardware
   •    Signs of wear, fatigue, cracking, or corrosion
   •    Stability and securement of the cargo box and contents
Do not use the Product if any component shows signs of damage or instability.

6. Driving Conditions & User Responsibility
You acknowledge that driving behavior directly impacts safety.
You agree to:
   •    Adjust speed based on load and environmental conditions
   •    Avoid aggressive driving (sudden stops, sharp turns)
   •    Stop immediately if noise, movement, or instability is detected

7. Assumption of Risk
You understand that use of this Product involves inherent risks, including but not limited to:
   •    Vehicle damage
   •    Loss or detachment of cargo
   •    Road hazards to yourself and others
   •    Serious injury or death
You voluntarily assume all risks associated with installation and use.

8. Misuse, Modification & Third-Party Components
You agree that the seller is not responsible for:
   •    Modifications or alterations of the Product
   •    Use with incompatible or defective components
   •    Improper mounting surfaces
   •    Failure of third-party systems (vehicle, rack, crossbars, cargo box, etc.)

9. Release & Waiver of Liability
To the fullest extent permitted by law, you agree to release, waive, and hold harmless the manufacturer, seller, designers, affiliates, and distributors from any and all claims, damages, or liabilities arising out of or related to:
   •    Improper installation
   •    Overloading or misuse
   •    Failure to follow instructions or inspect equipment
   •    Environmental or driving conditions
   •    Failure of third-party components

10. No Warranties Beyond Express Terms
The Product is provided “as is” except for any limited warranty expressly stated.
No implied warranties, including fitness for a particular purpose, are made.

11. Limitation of Liability
Under no circumstances shall the seller be liable for:
   •    Loss of cargo
   •    Vehicle damage
   •    Personal injury
   •    Third-party damages
   •    Any indirect, incidental, or consequential losses

12. California Waiver
For customers in California:
You waive rights under California Civil Code Section 1542:
“A general release does not extend to claims which the creditor does not know or suspect to exist…”

13. Governing Law
This Agreement shall be governed by the laws of the State of Wyoming, except where superseded by applicable law.

14. Acceptance of Terms
By purchasing, installing, or using this Product, you confirm that you:
   •    Have read and understood this Agreement
   •    Accept full responsibility for installation, use, and maintenance
   •    Agree to all terms stated herein
